FTA administrative penalties · VAT · Corporate tax
An FTA penalty is not automatically final—and relief is not automatic either. We first check whether the decision is wrong, whether a statutory waiver ground applies, or whether the unpaid penalty qualifies for an instalment plan.

The short answer
Yes, but these are separate applications. Under Cabinet Decision 105 of 2021, the FTA’s Committee may waive an administrative penalty in whole or part for qualifying circumstances, or approve an instalment plan for qualifying unpaid administrative penalties. Neither route writes off the underlying tax. A disputed FTA decision instead requires assessment of reconsideration or another review procedure.
The current FTA service card lists an online EmaraTax application, no government application fee and up to 110 business days to review and respond to a completed waiver or instalment request. Approval, amount and timing remain the Authority’s decision. SAIF’s first step is to classify the notice and reconcile the account—not to promise that a penalty will disappear.
Decision map
People search for “FTA penalty appeal”, “VAT fine waiver” and “Corporate tax penalty relief” as if they were one process. The legal question is more precise: is the notice wrong, or is the penalty valid but relief is sought?
Challenge the official FTA decision on its facts or legal basis. Record the notification date and assess the separate reconsideration deadline.

Route 01 · Waiver
The statutory waiver test is not “we had a difficult year”. The penalty must be an administrative penalty unconnected with a tax-evasion crime; the request must satisfy the Committee’s specified period; and the facts must fit a listed circumstance or another case the Committee assesses. Where direct causation is required, the evidence must show how the event prevented timely compliance.
Published examples include illness or death of a registered individual or sole-establishment owner, death, illness or resignation of a key employee, government restrictions, a general FTA or payment-system malfunction affecting a category of persons, certain mistaken payment through another person’s tax account and defined bankruptcy or insolvency circumstances. Each has conditions. An ordinary staff change, a private software outage or lack of cash is not automatically the same thing.
For a credible request, identify the particular violation, the deadline missed, the intervening event and the date the company corrected its position. The FTA requires an undertaking that the violation was corrected and will not be repeated. It may seek additional proof. The Committee decides whether to grant any waiver and, if so, how much.

The FTA’s published test concerns unsettled administrative penalties of at least AED 50,000; the Committee may amend that minimum. It is not an instalment scheme for the VAT or Corporate tax principal. The person should not owe payable tax for the period covered by the request. The penalties must not be in dispute before the Tax Dispute Resolution Committee, courts or other objection bodies, except through the reconsideration mechanism specified in the decision.
Before proposing a schedule, reconcile the tax account by period and tax type, separate principal tax from penalties, and identify anything already paid. Prepare a realistic cash-flow plan and the required undertaking to meet the Committee-approved schedule. The Committee sets the actual plan and may require a guarantee; the applicant cannot simply choose monthly amounts.
If an approved instalment is missed, the Committee may revoke the plan or direct collection action. A pending request is not a payment holiday. Keep monitoring EmaraTax while the application is under review.
Unpaid administrative penalties—not unpaid tax—subject to the Committee’s adjustment power and the other statutory criteria.

An application should allow the FTA to trace each penalty to the taxable person, period, violation and supporting reason. Article 5 of the decision also limits repeated requests for the same penalties, making first-submission quality important.
Complete decision, violation description, imposition date, tax type, period and a current EmaraTax statement.
Filed returns, payment confirmations, open tax balances and the calculation behind each penalty.
A dated account of what happened, who was responsible and when the obligation was eventually met.
Medical or employment records, government notice, system incident evidence or other documents that directly support the claimed circumstance.
For waiver, the required correction and non-repetition undertaking; for instalments, the commitment to follow the approved payment plan.
We compare the notice against registration data, returns and payment history; identify the correct application; build a dated evidence index; prepare the explanation and undertakings; then submit or support an authorised submission under the agreed engagement. We also track FTA questions and the resulting decision. Where facts do not support relief, we say so.
Important separate initiative
The FTA has a specific initiative for the administrative penalty for late Corporate tax registration. A taxable person may qualify by submitting its first Corporate tax return within seven months after the end of its first tax period. An exempt person has a corresponding annual-declaration requirement within seven months after the end of the first financial year. The FTA describes account credit for qualifying paid penalties.
This is not a blanket waiver of every Corporate tax fine. A late return, late payment, incorrect return or different registration issue may follow a different rule. Check the first tax period, actual filing date, EmaraTax penalty code and initiative conditions before advising that the AED 10,000 registration penalty will be removed.
For businesses with multiple notices, we map each penalty separately. A first-return filing may solve one registration penalty but does not automatically clear VAT balances, other Corporate tax penalties or the underlying tax.

Sign in to the taxable-person profile, open the relevant dashboard request and select either Penalty waiver or Penalty Instalment Plan. Enter the requested details, explain the basis, attach the supporting documents and submit. Save the acknowledgement and a copy of the complete application; a saved draft is not a submitted request.
The FTA estimates around ten minutes to submit a prepared application, but assembling and checking the underlying records can take longer. It lists its service as free and says review and response may take up to 110 business days from receiving a complete request. The Authority may ask for further clarification or evidence. Check the live service card and portal at filing time because interface labels and guidance can change.
Cabinet Decision 129 of 2025 changed parts of the VAT and Excise administrative-penalty framework effective 14 April 2026. Before seeking relief, verify the current penalty calculation and dates instead of relying on older online penalty tables.
Common searches, clear answers
These answers distinguish general penalty relief from a challenge to the decision and the Corporate tax late-registration initiative.
The FTA may approve a full or partial waiver of an administrative penalty if the statutory controls and qualifying circumstances are met. It is a case-specific decision, not an automatic discount for late filing or payment.
Potentially under the general administrative-penalty waiver framework. For a late Corporate tax registration penalty, also check the separate FTA initiative tied to filing the first return or exempt-person declaration within seven months of the relevant period end.
Reconsideration asks the FTA to change an official decision you believe is wrong. Waiver asks for relief from an administrative penalty under distinct statutory criteria. The evidence, legal test and time rules are not interchangeable.
An FTA committee may approve a payment plan for qualifying unpaid administrative penalties. The current FTA service card states a minimum of AED 50,000, subject to the Committee’s power to adjust that amount, plus other eligibility tests.
No. The instalment request concerns outstanding administrative penalties, not the tax principal. The FTA also says there should be no payable tax for the tax period covered by the request.
The published threshold is AED 50,000 for administrative penalties, although the Committee may adjust it. Do not assume a smaller balance qualifies; check the current FTA self-assessment tool and your specific tax type.
Cabinet Decision 105 defines waiver as potentially applying whether or not the administrative penalty has been settled. The merits, applicable timing and any account credit or refund mechanism still need separate review. Instalment requests, by contrast, concern unsettled penalties.
Not automatically. The published waiver cases focus on specified events and a proven connection to the failure, with other cases subject to the Committee’s assessment. Difficulty paying is not the same as proving waiver grounds.
This can be a statutory waiver circumstance where death, illness or resignation of a key employee directly caused the missed tax obligation. A company should evidence the employee’s role, timing, loss of access or continuity plan and the eventual correction.
The decision refers to a general malfunction affecting a category of persons, directly causing late compliance. An isolated login problem should not be presented as automatically qualifying; retain contemporaneous incident and FTA-support evidence.
The FTA service card directs applicants to EmaraTax, where the dashboard presents separate Penalty waiver and Penalty Instalment Plan requests. Select the correct application, complete the facts and attach the supporting documents.
Yes. The FTA lists the government service as free. A professional firm’s review, evidence preparation and representation fees are separate and depend on the agreed scope.
The current FTA service card allows up to 110 business days from receipt of a completed waiver or instalment application. That is an estimated authority process, not a promise of approval or a fixed payment-hold period.
Cabinet Decision 105 states that a person should not make more than one waiver or instalment request concerning the same administrative penalties under review. Prepare the first application carefully and respond fully to any document request.
Do not assume so. An application is not approval. Keep monitoring the EmaraTax account and payment obligations; if a plan is approved, meet every instalment date because non-payment can lead to revocation or collection action.
No. SAIF can check the route, reconcile the figures and build an evidence-led application under an agreed appointment. The FTA and its Committee determine whether relief is available and to what extent.
