UAE Tax Residency Certificate services

Need to prove UAE tax residence to a foreign tax authority, bank or counterparty? SAIF helps individuals and companies select the right certificate, test eligibility, organise evidence and submit a supported application to the Federal Tax Authority.

The FTA issues the certificate. A UAE visa, company licence or Corporate tax TRN alone does not guarantee it.

The short answer

What is a UAE Tax Residency Certificate?

A Tax Residency Certificate (TRC) is an official document issued by the UAE Federal Tax Authority confirming that a person is a UAE tax resident for an approved period. The FTA offers certificates for a Double Taxation Agreement (DTA) and for purposes other than a DTA. The applicant can be a natural person or a juridical person, subject to the applicable residence and documentation rules.

Start with the receiving party’s request. A foreign tax authority claiming withholding tax relief may need a treaty-purpose certificate for a named country and year, sometimes with its own form stamped. A bank or other recipient may need evidence of residence for a different purpose. Selecting the wrong purpose, person or period can make an otherwise valid document unusable.

SAIF’s role is to review the facts, prepare the evidence and assist with the FTA application. We do not issue TRCs, decide foreign-country tax residence or guarantee treaty benefits. The FTA’s current service card governs the application and fees.

Choose the correct route

Domestic-purpose or treaty-purpose TRC?

Both certificates concern UAE tax residence. Their use, evidence and legal tests can differ, so the end recipient’s requirement should be checked first.

01 · Other purposes

Proof under UAE domestic residence rules

The FTA assesses residence under UAE legislation, including Cabinet Decision No. 85 of 2022 and implementing rules. For an individual, this can involve days physically present, a legal right to reside, a permanent home, work or business, or the centre of personal and financial interests. For a company, establishment and effective management may matter.

Ask the bank, authority or other requester exactly which period and type of proof it needs. A domestic-purpose certificate should not be assumed to satisfy a foreign treaty claim.

02 · Treaty purposes

Evidence for a specific double tax agreement

The application identifies the relevant treaty country. The FTA reviews residence in light of the applicable DTA and its conditions; it may ask for additional evidence. A treaty certificate supports a claim, but the other country still applies its own procedures, including any prescribed forms and tests for the income concerned.

Foreign-source dividends, interest, royalties, service fees or capital gains can raise different questions. Confirm the treaty, income type and recipient before treating a TRC as the complete answer.

A certificate is not the same as a Corporate tax registration certificate, VAT TRN or UAE immigration residence visa.

Natural persons

Does an individual qualify for UAE tax residence?

The familiar “183 days” rule is only one of the domestic routes. Presence is measured within a relevant consecutive 12-month period; the FTA guide says a day or part-day of presence normally counts as a day, and the days need not be consecutive. Exceptional circumstances need separate consideration.

The 90-day route is conditional: the individual must be a UAE or GCC national or hold a valid UAE residence permit, and must also have a permanent place of residence in the UAE or carry on employment or business here. A dwelling need not be owned, but it must be continuously available—not merely a short hotel stay. A third route considers where the person usually or primarily lives and where personal and financial interests are centred.

These are domestic residence tests, not an automatic treaty conclusion. A person connected to two countries may face a treaty tie-breaker or foreign tax-residence challenge. We review travel records, home, employment, family and financial connections in the context of the requested certificate.

Juridical persons

What does a UAE company need to show?

A company incorporated, formed or recognised in the UAE can be a UAE Tax Resident. That includes companies established in free zones. For a foreign-incorporated entity, effective management and control in the UAE is a separate factual question; a UAE branch is not automatically a separate UAE resident legal person.

The FTA currently requires a company applying for a TRC to have been incorporated or established for at least 12 months. For a current certificate period, an eligible juridical person can generally apply after three months of that period have elapsed. Those timing rules should be checked separately from the recipient’s deadline.

A Corporate tax Group itself cannot obtain one TRC covering all its members: the FTA says each eligible member applies in its own name. For cross-border treaty claims, examine the relevant agreement and any dual-residence or effective-management question rather than relying only on the trade licence.

Company file: the questions we check

  • Is the exact applicant the legal entity that earns the relevant income?
  • Does the licence, incorporation certificate, lease and memorandum identify the same entity?
  • Is a Corporate tax TRN available, and does it match the applicant?
  • Who is authorised to sign, and is that authority documented?
  • Is management and control evidence needed for this entity?
  • Does the selected certificate period match the foreign requirement?

Evidence before submission

Tax Residency Certificate documents checklist

The FTA may request more information than a standard checklist. We match the evidence to the applicant and the domestic or treaty purpose before submission.

For an individual

  • Emirates ID and passport, with a resident permit where applicable.
  • Official entry and exit report for the requested period.
  • Tenancy, title, utilities or other evidence of a continuously available UAE home when relevant.
  • Employment contract, salary certificate, trade licence or other UAE work or business evidence when relevant.
  • Evidence of personal, economic and financial connections if the centre-of-interests route is relied on.
  • The recipient’s letter or foreign tax form showing country and period.

For a company

  • Current trade licence, lease and certificate of incorporation.
  • Memorandum of Association and any name-change history.
  • Corporate tax TRN, if available.
  • Authorised signatory’s identification and proof of signing authority.
  • Written management-and-control explanation with supporting records where relevant.
  • Recipient’s treaty, withholding or bank request, plus any international form.

A passport scan, visa or licence on its own may be insufficient. Inconsistent legal names, unsupported travel-day calculations and a period different from the foreign form can delay the request. The FTA’s August 2026 service card takes precedence over older checklist language if they conflict.

SAIF’s application support

From a residence question to a usable certificate

Our engagement can cover an eligibility review, evidence preparation and application assistance, or a narrower review of a file already prepared.

01

Define the request

Identify the applicant, certificate purpose, foreign country if treaty-related, required period and any foreign form or deadline.

02

Test the facts

Review individual presence and residence evidence or company incorporation, management and entity records against the relevant FTA route.

03

Prepare the file

Reconcile names, dates, licences, TRNs and supporting documents. Resolve gaps before paying the government application fee.

04

Apply and follow up

Submit through the FTA service with the applicant’s authority, monitor requests and provide the issued certificate to the intended recipient.

We first confirm the applicant’s authority and the exact scope of representation. If a foreign jurisdiction’s treaty interpretation, residence conflict or withholding-tax procedure is material, we identify that as a separate question rather than implying the UAE certificate resolves it.

Once the FTA approves a request, the digital certificate is available through the service and sent to the registered email. A printed certificate or stamped international form requires its own selection and handling.

Budget and timing

What will the FTA charge, and how long will it take?

Government charges depend on whether the applicant has a Corporate tax TRN and whether a hard copy is requested. They are separate from SAIF’s agreed professional fee. Confirm the FTA’s live service card when you apply.

The FTA currently estimates ten business days to process a completed TRC application. Missing or inconsistent evidence can add time. The FTA publishes separate periods for hard copies and international-form attestation, so allow for the full process if an overseas deadline is involved.

The FTA states its fees are not refunded if an application is rejected. Check whether a foreign authority needs an original, a stamped international form or only the digital TRC before paying for extras.

Questions people ask

UAE TRC FAQs

These answers summarise the FTA’s currently published requirements. The certificate purpose, period, applicant and relevant foreign jurisdiction can change the result.

Ask about your application →
01What is a UAE Tax Residency Certificate?

It is an official certificate issued by the Federal Tax Authority (FTA) confirming UAE tax residence for a specified period. An applicant chooses a certificate for a relevant double taxation agreement or for another purpose. SAIF can help prepare an application, but does not issue or guarantee the certificate.

02Is a UAE residence visa enough to obtain a TRC?

No. A visa or Emirates ID is evidence of legal residence, not a complete tax-residency test. For domestic purposes, an individual may meet the 183-day test, the conditional 90-day test, or the usual or primary residence and centre-of-interests test. For treaty purposes, the relevant agreement and FTA requirements must also be considered.

03Can I get a UAE TRC after 90 days?

Possibly for domestic purposes, but 90 days alone is not enough. The individual must also be a UAE or GCC national or hold a valid UAE residence permit, and must have a permanent place of residence in the UAE or carry on employment or business here. A treaty-purpose request requires a separate analysis of the treaty and FTA service-card evidence.

04Do I need 183 days in the UAE for every TRC?

No single day-count answer fits every application. The domestic rules include more than the 183-day route. The FTA service card also distinguishes treaty-purpose applications, for which the relevant double taxation agreement and supporting evidence must be reviewed.

05Can a UAE free-zone company apply?

A juridical person incorporated or otherwise formed in a UAE free zone may be a UAE Tax Resident and apply, subject to the certificate requirements. A free-zone licence does not itself prove treaty entitlement, and the applicant—not a Corporate tax Group as a whole—must satisfy the relevant test.

06Can a newly formed company apply immediately?

The FTA’s current service card says a juridical person must have been incorporated or established for at least 12 months. For a current certificate period, a juridical person may generally apply after three months of that period have elapsed, once it meets the other requirements. These are separate timing tests.

07Can a Corporate tax Group obtain one certificate for every member?

No. The FTA says a Corporate tax Group is not itself an incorporated or recognised entity for this service. Each member that needs a TRC applies individually and must meet the applicable conditions.

08Do I need a Corporate tax TRN to request a TRC?

The FTA application permits a “No Tax Registration Number” selection where applicable. A Corporate tax TRN can auto-populate details and affect the government fee. For a treaty application, the other contracting state may require Corporate tax registration; assess that requirement before selecting the route.

09How long is a UAE Tax Residency Certificate valid?

It covers the Tax Period or other period selected and approved by the FTA, not more than 12 months. It cannot be issued for a future period that has not begun. If a foreign authority needs a particular year or date range, confirm it before filing.

10How much does the FTA charge for a TRC?

The FTA’s August 2026 service card lists a non-refundable AED 50 submission fee. The electronic-certificate fee is AED 500 for a Corporate tax registrant, AED 1,000 for a natural person without a Corporate tax TRN, or AED 1,750 for a juridical person without one. A hard copy adds AED 250. SAIF’s professional fee, if engaged, is separate.

11How long does the FTA take to issue the certificate?

The FTA service card estimates ten business days from receipt of a completed application. Requests for missing documents or other review issues can extend the total elapsed time. A hard copy and any international form follow separate steps; do not promise a delivery date to an overseas counterparty before approval.

12Will a TRC automatically remove tax in another country?

No. It is evidence of UAE tax residence, not an automatic exemption from foreign tax. The foreign country applies the relevant treaty, its domestic rules and its own forms or procedures. Some cases require assessment of beneficial ownership, permanent establishment or dual residence.

13Can the FTA stamp a foreign tax form?

The FTA offers attestation of a completed international form linked to the relevant TRC. The country and period on the form must match the certificate request, and the applicant must complete and sign the form. The FTA does not fill out the foreign authority’s form for the applicant.

14Which documents should I send SAIF first?

Tell us whether the applicant is an individual or company, the country requesting proof, the intended use, the certificate period and the deadline. Individuals can share residence and entry/exit evidence; companies can share the licence, incorporation records, lease and signatory details. We will agree the full evidence list after checking the application route.
